  1. Students should be able to identify and apply Mappes’ criteria for determining when one person uses another person in a morally significant sense.
  • We use someone in a morally significant sense if we are getting someone to do something that we want them to do without informed voluntary consent.
  • “Person A is guilty of sexually using another person (B) if and only if A intentionally acts in a way that violates the requirement that B’s sexual interaction with A be based on B’s voluntary informed consent.”
  • Person A can sexually use person B by deceiving, coercing, and also by taking advantage of B’s desperate situation.
  • Violations of the informed required include: lies, deception, and withholding information.
  • Violations of the voluntary requirement: Occurrent coercion, and dispositional coercion.
  • Deception­ affects the “informed” part of voluntary informed consent
  • Example of Deception: “Mr. A is aware that Ms. B will consent to sexual involvement only on the understanding that in time the two will be married. Mr. A has no intention of marrying Ms. B but says that he will.”
  • Coercion­ undermines “voluntary” part of voluntary informed consent.
  • Lying vs. Deception­ A deceptive statement generally is technically true, intends for listener to draw a reasonable inference that is false. Lying is making a false statement with the intent of having the other person believe that it is true.

2. Students should be able to identify and apply Mappes’ distinction between “occurrent” and “dispositional” coercion.

  • Occurrent Coercion ­- involves the use of physical force to get what we want from others
  • Example of Occurrent Coercion: “If I am thrown forcibly out of my office by an intruder, I am the victim of occurrent coercion.”
  • Dispositional Coercion – involves a threat of harm
  • Example of Dispositional Coercion: “If I leave my office because an intruder has threatened to shoot me if I do not leave, I am a victim of dispositional coercion.”
  • The victim of occurrent coercion has no choice in what happens, but the victim of dispositional coercion intentionally chooses a certain course of action.

3. Students should be able to identify and apply Mappes’ definitions of “threats” and “Offers.”

  • Whereas a threat is coercive, and offer is not.
  • Offers are not morally wrong unless they are extremely coercive (almost a threat)
  • Taking advantage of someone’s desperate situation is using someone immorally.
  • Ex: Threat­ -“If you do not do what I am proposing you do; I will bring about an undesirable consequence for you.” The person is worse off after the proposal/upon noncompliance.
  • Ex: Offer­ - “If you do what I am proposing you do; I will bring about a desirable consequence for you.” The person is not worse off after the proposal/upon noncompliance.
  • Coercive offers­ - offers which entail offering something extremely enticing or even essential to coerce consent. Deprived of a genuine need of something rather than a want.
