Responsibility 2 Based in New Jersey PharmaCARE We CARE about YOUR health is one of the world s most successful pharmaceutical companies best known as a caring ethical and wellran company producing highquality products that save millions of lives while enhancing the quality of life for millions of others PharmaCARE offers free and discounted drugs to lowincome consumers has a foundation that sponsors healthcare educational programs and scholarships and a CEO whom sits on the PhRMA board The PhRMA board along with the low income consumers the foundation CEO the State of New Jersey and its employees are the key stakeholders of PharmCARE PharmaCARE also has a large manufacturing facility in the African nation of Colberia So that would make Colberia and the Colberian s key stake holders as well Stakeholders are persons groups or organizations who share common interests andor concerns within an organization Stakeholders may sway or can be swayed by actions of the organization their purpose and guidelines Although all share a common interest not all stake holders are equal The consumers are warranted fair trading practices within organizations but do not receive the same concern as an employee However in the case of PharmaCare not even all employees are treated equally PharmaCARE has been made known of the indigenous cures in Colberia Along with utilizing their natural resources to make pharmaceuticals they are employ Colberians satisfied with working for as little as 100 per day Their job consists of walking a total of ten miles back and Ethics and Corporate Responsibility 3 forth through the jungle with baskets of harvested plants weighing as much as fifty pounds The communities in Colberia are very poor and subpar Many live in primitive huts and have no running water or electricity But the execs have been identified as living in luxurious subdivisions equipped with swimming pools tennis courts and golf courses This poses as discrimination and a violation of human rights Human rights are rights essential to all human beings whatever their nationality place of residence sex national or ethnic origin color religion language or any other status Everyone is to be equally entitled to their human rights without discrimination These rights are all interrelated interdependent and indivisible Recently there have been an impressive amount of advances signifying international thoughts and actions in regards to action on indigenous issues and rights including the adoption of the UN Declaration on the Rights of Indigenous Peoples in 2007 Employment Discrimination laws aim to prevent discrimination based on race sex religion national origin physical disability and age by employers An increasing body of law seeks to also prevent employment discrimination because of sexual orientation Discriminatory practices include bias in hiring promotion job assignment termination compensation retaliation and various types of harassment Employment discrimination laws consists mostly of federal and state statutes The Fifth and Fourteenth Amendments of the US Constitution limit the power of the federal and state governments to discriminate The Fifth Amendment has a definitive requirement that the federal government not deprive individuals of quotlife liberty or propertyquot Ethics and Corporate Responsibility 4 without due process of the law It also contains an absolute guarantee that each person gets equal protection of the laws Title VII of the Civil Rights Act of 1964 prohibits discrimination more so in regards towards the employment relationship The act also enforces the constitutional right to vote to confer jurisdiction upon the district courts of the United States to provide injunctive relief against discrimination in public accommodations to authorize the attorney General to institute suits to protect constitutional rights in public facilities and public education to extend the Commission on Civil Rights to prevent discrimination in federally assisted programs to establish a Commission on Equal Employment Opportunity and for other purposes httpswwwlawcomelleduweXemploymentdiscrimination PharmaCARE is quite hypocritical They recently launched a new initiative We CARE about YOUR world pledging their dedication to the environment by recycling packaging changes along with other green initiatives The company s lobbying efforts and PAC have successfully defeated environmental laws and regulations PharmaCARE s extensive activities in Colberia have destroyed habitat and endangered native species breaking an environmental law Environmental laws consist of Federal Law The National Environmental Policy Act NEPA passed in 1970 as well as the Environmental Quality Improvement Act the National Environmental Education Act and the Environmental Protection Agency EPA The focus of these federal acts was to make sure the environment was protected against public and private actions that did not take account of costs or harms placed upon the ecosystem The EPA is designed to monitor and analyze the environment conduct research and work closely with state Ethics and Corporate Responsibility 5 and local governments to devise pollution control policies NEPA was developed to force governmental agencies into considering how their decisions effect the environment Environmental law is divided into two categories pollution control and remediation on the one hand and conservation of natural resources on the other Authority of these laws come from many different sources and largely affected by international treaties PharmaCARE s actions were not in respect to the indigenous people of Colberia in accordance to the below ethical theories 0 Utilitarianism is the ethical theory that puts the locus of right and wrong based on outcomes consequences of choosing one action over another As such it moves beyond the scope of one39s own interests and takes into account the interests of others By allowing the indigenous of Colberia to live in conditions as they do and work for so little while rewarding executives PharmaCARE showed interest in themselves only Deontology is an approach to Ethics that focuses on the rightness or wrongness of actions themselves as opposed to the rightness or wrongness of the consequences of those actions Consequentialism or to the character and habits of the actor Virtue Ethics PharmaCARE has shown no regard to the wrongdoing of the Colberians 0 Virtue ethics currently one of three major approaches in normative ethics Initially identified as the one that stresses virtues or moral character instead of emphasizing duties or rules deontology or that which emphasizes the consequences of actions consequentialism Ethics and Corporate Responsibility 6 0 Ethics of care implies that there is moral importance in the fundamental elements of relationships and dependencies in human life Normatively care ethics seeks to maintain relationships by contextualizing and promoting the wellbeing of caregivers and care receivers in a network of social relations PharmaCARE did not imply a moral importance to the well being of the Colberians If they did they would pay them better possibly build them adequate housing provide clean water and electricity and maybe even provide a better system of transporting harvested plants to where they would not have to endure the walk or the weight of their baskets Like a cart system 0 Your own moral ethical compass consists of one s personal morality The concept of morality is quite simple It identifies behavior or duties based on what is right and wrong Morality is considered to be the basis of character and is wrapped around ethics BP one of the largest Oil and Alternative Energy companies in the world like PharmaCARE went against the grain of their promise of conduct BP s code of conduct reads Our code of conduct is based on our values and clarifies the ethics and compliance expectations for everyone who works at BP The normative ethical theories consequentialist utilitarianism and the nonconsequetialist Ethics of Duties are theories which show a grave contrast to the nature of business ethics seen by BP Unlike BP who in 2010 had an oil rig explosion killing 11 people and injuring 17 others PharmaCARE has no known injuries or fatalities Also BP put their employees as well as the surrounding communities as risk causing OSHA violations OSHA was created to make sure Ethics and Corporate Responsibility 7 your rights to a safe workplace are protected OSHA regulations require employers to take specific measures to protect you from recognized hazards PharmaCare appears to have discriminated against their employees by under paying them While taking over their natural resources This is an example of Elements of Eminent Domain The Colberians property have or can be taken by the government because of the health benefit and healing properties it natural
