Punishment versus Rehabilitation 1 Punishment versus Rehabilitation: Final Project Position Paper Axia College of University of Phoenix Punishment versus Rehabilitation 2 Since every individual should be held accountable for his or her behaviors and measures, rehabilitation is essential once the concern of the juvenile justice systems comes into play, seeing as concentrating on punishment is not fixing the present issue and it is singly getting dire. Countless aspects are assisting in the dishonesty of numerous individuals in America. There will shortly come a period in which jails and prisons are as customary as schools sitting inside all vicinities. Parents and legal guardians are no longer enduring the responsibility for their children. The educational courses that are important for children to progress and value ethical and criminal law are becoming naught additionally. There are various traditions that deter children from a criminal lives however while crime is becoming a disease for America premature discovery is fundamental. As kids majority of individuals are raised and taught that they must be held accountable for their behaviors and measures and will be reprimanded if they unsuccessfully make the decision to comply and behave according to ethical and criminal ruling. Numerous years in the past, the present criminal justice system may have been model. While mainly parents and legal guardians comprehended that, they are required to get their children ready for maturity. It was enormously extraordinary to discover a parent or legal guardian whom did not infuse these beliefs into their off springs. Presently countless men and women fall short of being involved in their children’s lives. In addition, these same parents or legal guardians do not supply their children with the essential building blocks to accomplish a triumphant level of maturity as adults Punishment versus Rehabilitation 3 liberated of ethical and criminal injustices. This nearly permanent issue causes children to evolve into career criminals, which starts prematurely. As soon as children are born, there are numerous requirements, which must be met consequently for children to become content psychologically. One of the initial necessities that should be met with these children is the simplicity of communication with their parents or legal guardians. Children must be pampered and protected by their parents or legal guardians in order to establish their initial bond their parents or legal guardians. This establishes a sagacity of security and affection, which will stay in these children’s intuitive memories for the remainder of their lives. Next is the necessity to have a passive upbringing. It is universal to take notice of how certain people articulate that children at a specific age are similar to “sponges”. In a sense, this is accurate since there are countless things that could happen at the earlier stages in children’s lives that will cause them to take an altered path. In addition, just like “sponges” children have the tendency to absorb the behaviors and actions of those around them. For instance, if there is a consistency in hostility, vocal, poignant, sexual abuse, the deficiency of parental guidance or support this can cause problems within children’s lives later down the road. In addition to the lack of parent or parents, drug and alcohol misuse, or any other harmful aspect initiated into children’s lives can confuse and mislead these young individuals. These reasons also cause children to process these behaviors as typical and acceptable and they may feel as though these conducts are allowed and grow comfortable with the use of these. These issues could influence both male and female children in a diverse manner however; there will forever be some sort of reaction to any kind of impulse (negative or positive). Punishment versus Rehabilitation 4 Male Children who are raised around or watch abuse are more probable to become abusers themselves. These male children normally undergo the continuous cycle of abuse in whatever manner they saw abuse or was a victim to the abuse. This typically means that if a male child was abused sexually then it is possible that this young male will mature into a pedophile or develop severe sexual confusions. Female children who are abused generally subconsciously seek out men who are abusers. This abnormality is produced by the female’s comfort zone in my belief. In view of the fact that this is something that she has gone through in her infancy then she acknowledges just how to take care of it psychologically. Additionally she may have severe psychological obstacles that do not permit her to consider that she can or will seek somebody else that will treat her as she deserves. Female children who do not have the presence of one of her parents or legal guardians will generally behave in a destructive manner, which includes sexual promiscuity, hostility, and drug use. These are not the aspects singly that cause a child to ruin their lives, because there are tons of reasons, these are just some of the more common ones. It would be simple to comprehend why crime rates are increasing tremendously once recognized how easy it is for distinguishing imperfections like these can be passed along to children. If an offender has a couple of children then it is likely in some sense that these children will react to what they have seen from their parent. If these couple of children has two children each then there are now six children whom are affected by one individual’s behaviors. Criminal minds are not singly produced in a child’s residence. Children have the tendency to develop idiosyncrasies in which they have seen and assimilated from individuals within their communities or even through the media or whatever they take a general curiosity in. Once children are deprived of direction and fall under the belief Punishment versus Rehabilitation 5 that nobody is concerned about them next they will inquire about love, consideration, and recognition from other places when not properly supplied these things at home. This causes them to seek influence, guidance, or affection from individuals such as members in gangs, associates and friends that will pretend or fulfill these special needs. Additionally individuals such as these will make children feel as though they have to do whatever it takes to be accepted by them and make these troubled young people feel the need to please these individuals at any cost even if it means committing crimes and acting out of their nature. Children may be inclined to believe they are insignificant to their parents or legal guardians in turn allowing the radio, television, or internet to raise them. This causes things like television shows and programs to encourage their thoughts and minds. When children see that they illustrate criminals, having pleasant lives surrounded by beautiful women and powerful men, money in their possession at all times, fancy and expensive houses and cars this puts images in their brains that they could do whatever they liked in order to attain and maintain this type of lifestyle. Which may involve children thinking in order to have a life like this or having nice things in general they will have to begin a criminal life not making them aware that they may have to rob banks or harm individuals in the process. The foundation of organizing this issue lies within prevention and rehabilitation. Stipulating that a fellow citizen, companion, instructor, or family member starts paying attention to the fact that a young individual or children is a witness to or is becoming drawn into a parent or legal guardian’s pessimistic or destructive actions then it is their part of their obligation to ensure this child or children is detached from the home or given counseling and rehabilitation to overturn any conducts that the child or children will ultimately mimic and Punishment versus Rehabilitation 6 perhaps take to a new stage. If educators and daycare employees are educated to concentrate on the warning signs of abuse or potentially detrimental activities then steps could be taken to disclose the origin of children’s downbeat etiquette and then courses and counseling can be given and taken to aid the children before they reach a certain breaking point. If every individual recognized that, it takes a community to raise a child or children then this can assist every individual to observe for signs in children like warfare, melancholy, injurious acts towards other individuals and animals, cruel irritation, fetid lingo and any criminal acts then every individual can assist these children even if they are not on their own. Through the unification of every individual aiding the children around them at that time they are in fact defending their own familial affiliates and loved one since these potential adults are the ones whom will be committing crimes that will have an effect on the members of the community. If every individual participates then if the child slips through one individual’s view, like the child’s parent or legal guardian, then somebody else will take notice of the warning signs. If there is, only an educator or single parent/legal guardian attempting to take care of various children then more than likely it will be easier for the child to slip through the cracks. In addition, the next individual to recognize that the children have issues will be the individual that has been victimized or the law enforcement official that arresting them. Once the structure of rehabilitation is created only then can parents or legal guardians who are lacking the obligatory abilities to guide a young individual into an appropriate maturity can be given mandatory parenting courses and participate in meticulous therapy sessions. By educating Americans to pass on the knowledge to one another about this will ultimately alleviate a vast deal of weight off the justice system. If there were a bigger concentration put on rehabilitation then we would Punishment versus Rehabilitation 7 possess the capability to cure this disease infecting America versus dividing the individual until they become well or allowing them to remain secluded until death. One way or another, the present structure is not curing the issue. Usage of this system of reprimand to correct America’s crime tribulation is similar to pouring a container of water on a woodland combustion. The structure is inundated and there is no conclusion in display. Concentrating on rehabilitation will influence all regions of our criminal justice system counting law enforcement, probation, court practices and intervention program. The affect will necessitate an entire renovation of the whole structure. Since this will be arduous and complicated, it will be well worth it. This modernization of the criminal justice structure will alter the process in which everything works from seizures to the sentencing procedure. If an alteration is begun now then within several years, America will be well on its way to eliminating and deterring crime as an alternative to observing it engorge. Countless individuals are under the belief that adults should held accountable for their behaviors however if children they are not educated and guided on how to be a industrious constituent of society and they were decrypted psychologically then the justice system will have to initiate the refinement of these people and their criminal attributes. If the government would abolish frolicsome expenditures and necessitate individual nations to correctly, budget their funds then this intemperance could aid in funding this achievement preparation. Presently there are programs that have been created to aid the troubled youth nevertheless; the bulk of these programs are for past criminal actions. Numerous programs are not obtainable except if children commit crime. This makes significant assistance both Punishment versus Rehabilitation 8 unachievable because it must be court instructed or too luxurious for lowincome families. If rehabilitation was more customary then the funds needed to maintain the jails and prisons would diminish and then the surplus subsidizations could go toward additional outreach programs for concentrated national rehabilitation. Law enforcement, probation and court procedures would have to alter significantly in order to equip the nation towards rehabilitation sentencing and punishment by means of confinement will be the final channel exertion. If the procedure of rehabilitation starts with young children and teens then the justice structure could evade the youth from distributing violent behavior and abhorrence to their children. Once the rehabilitation development touches the children then the government can start rehabilitating the present prisoners who are confined. Probation must then necessitate extreme administration, systematic therapy, courses and community supporters, which will act as strength of character for the prisoner’s rehabilitation. Intervention programs must integrate more than familial. In view of the fact that there are people lacking family there must be sanctions which will permit community affiliates to call for a legitimate intervention. At this time, a crime must be committed for law enforcement to come in and try to aid a juvenile offender. The law must be altered in order parents, legal guardians’ associates, or spectators to demand assistance from the juvenile justice structure after a crime is committed. The present structure is the correspondent to waiting for a woodland combustion to begin even after the fire department can see the smoke. The present justice structure is basically housing prisoners in protected structures collectively for periods of time and this is worse than leaving these individuals on the streets. Punishment versus Rehabilitation 9 As soon as an illness contaminates an individual, it has the capability to become a super illness if it unites with a similar strain. This is similar within the justice structure. Once offenders are crammed into a swarming residence to execute a sentence for a crime they committed this permits them to affiliate with prisoners and this establishes a kind of super criminal. Gaining information or behaviors from other offender facilitates the prisoner to become a superior offender. If chastisement actually worked then the crime rate would gradually decline in opposition to discharging all over the nation. According to the U.S. Department of Health and Human Services, “Building caring and supportive relationship between youth and people from least one of their spheres of influence decreases problem behavior and increases young people’s ability to refuse alcohol and drugs. Prevention programs that encourage change in adolescent behavior patterns that often lead to substance use may break the link to substance abuse. Parents and caregivers play an important role. Their intense involvement in children’s lives through the teen years is critically important to youths’ ability to avoid alcohol and drug use and other risky behaviors. Alcohol and drug prevention programs that concentrate on the family unit and emphasize the active involvement of family members can improve parenting skills and family relationships. Alternative activities – such as involvement in sports, the arts, or outdoor activities – are popular approaches to prevention. However, it is the positive adult interaction that the youth experiences, rather than the activity that acts as a protective factor against alcohol and drug use. Prevention programs can be effective in changing individual characteristics that predict later substance abuse. Prevention programs can reduce delinquent adolescent behavior associated with alcohol and drug use and drugrelated crime. Teaching life skills to adolescents as part of Punishment versus Rehabilitation 10 prevention programs – such as decision making, problemsolving, resisting peer pressure, and social and communication skills – reduces the occurrence of substance abuse (Prevention that Works, 2009).” It is obvious that the present justice structure is rigorously inconsistent. Devoid of an alteration almost immediately, this pandemic will continue to destroy the youth who will in turn enter into maturity as liars, thefts, and criminals.
