Week 5 D04 When Ethics and the Law Collide Is it possible for a communication to convey a message that is legal but ethically wrong Is it possible for a message to be ethical but not legal Briefly explain your answers and provide an example of each case Response 1 Ethics is a system of moral principles that govern the conduct of a person or group The use of ethics in society is what makes a society The variability in ethics comes from the moral base on which the ethics are founded The most Visible example today is the contrast of the ethics of Islam and those of classic Christianity In Christianity it is not ethical to use a stick to punish your wife for disobedience In Islam this not the case based on the morality taught this is an ethical practice and if you adhere to those teachings then this action is moral Another example is if you are Moslem you may lie to an unbeliever if it will advance the cause of Islam In Christianity one is admonished to always speak the truth Both of these positions are moral in the eyes of the believer yet show the diametric position of each Response 2 I believe that it is possible for a communication to convey a message that is legal but ethically wrong In some counties it is legal to shoot a neighbor39s dog if it becomes a nuisance on your property The law would probably define 39nuisance39 as aggravating livestock digging holes in the yard or garden or causing harm to your person Some of the neighbors seem to have different opinions concerning 39nuisance39 though They may consider fecal matter in the yard as a nuisance and they could shoot the dog Ethically speaking the neighbor should not shoot another39s pet without giving warning The neighbor should speak to the owner and advise them to keep the dog tethered or at least of their property before they do any harm to the animal I also believe that a message can be ethical but not legal If a crime is being committed then a message could be sent that the criminal should be detained until the police arrive This seems ethical because criminals should be apprehended for their crimes and an argument could be made that it was a citizen39s arrest However it is illegal to hold another human being against their will This falls under kidnapping laws It is unfortunate but a criminal could probably be set free for an illegal act against him What would be your thoughts Do you think this is illegal Response 3 I must admit that l have moments where I seriously doubt the preservation of ethics and values of society I39ve experienced war and I39ve witnessed many things in life that bring to question legal and ethical circumstances I find reason through common sense and the longer I live the more I realize that common sense isn39t very common at all Let39s discuss the rules governing illegal aliens in our own country for a moment It39s against the law to cross our boundaries illegally but once they39ve done so they39re given benefits and full sanctuary in certain instances In a case related the illegal alien issuea rancher shot an illegal alien in self defense for trafficking drugs through his property but was later sued for doing so Ethically he had the right to protect himself and his property but he was found to have acted illegally I39m still trying to wrap my mind around that one Response 4 It is definitely possibly for a communication to convey a message that is legal but ethically wrong An example of this would be abortion It is legal to have an abortion some places even promote this but it is ethically wrong to kill a human life This is a very controversial topic and I could argue it with myself for hours about whether or not I agree with it or not Ethically it is wrong to kill a life but legally it can be done I feel that there are many laws that seem ridiculous and are very unethical It can really depend on who is doing the law making Hitler was a perfect example of this he made things legal but completely unethical It can also be possible for a message to be ethical but illegal I have the perfect example for this l was in labor with my daughter and I begged my husband to speed even though it was illegal to do so It was ethical for him to rush me to the hospital because I was in labor but illegal for him to speed and run red lights An emergency situation would make it ethical to push the laws of traffic but you may still receive a ticket because it is illegal
