Future Crime Scenario Paper CJA 314 Every day there are millions of ideas trying to get patented. Much research has been invested into these ideas in order for it to stand a chance of becoming patented. Doctors come across many types of different things daily and come up with many new ideas for new technologies that they believe will help aide the future. There was a doctor that had come up with the idea of using technology to genetically alter organisms for use in human organ growth and transplant. The doctor had been conducting research over the past few years and truly believes that the idea will become patented. Should the doctor by chance be denied, the research will continue, but should that legally be allowed? No Patent? What does it mean when an idea does not get patented? In order for something to get a patent the FDA has to approve of it. The FDA has a list of criteria that any new idea would have to pass. If for any reason the idea does not pass “the inspection” than the FDA will deny having the idea patented. The doctor feels as though the idea is a breakthrough even if the FDA does not think it is. The doctor has been conducting trial run with this new technology even before attempting to have it patented. If the FDA should decide to not allow this new technology to become patented that would be a clear indication that the doctor cannot conduct any more sessions with the use of this technology. Should the doctor’s activity be considered a violation of the law, a deviant act, or neither? Not possessing a patent does not mean that the doctor have to stop doing research. The patent just defines that the new technology is useful. If the research does not pose in damagers to anyone the act should not be considered a violation. The doctor’s continuing research could lead to the invention becoming patent in the future. For a long time living organisms were not included in patent laws. The first case back in 1980 Diamond v. Chakrabarty was considered patentable because the action was not naturally taking place, man was creating the genes. If no harm is done to anyone the doctor should be able to continue the research. It could be considered a violation of law if the doctor were trying to sell or allowing people to use the creation that could be dangerous, if the organism has not been approved. Often when it comes down to situations involving science people make their choice based on how they feel, their views toward life, and manmade creations. Protecting people and animals from testing is the main concern, if such actions are not taken place, there should not be any violation. If this activity is a violation of the law or should be, how may it be stopped, especially if the doctor goes overseas? This can cause many problems overseas. Other countries take other approaches for example, in the United States patent requirement normally go to the first to invent. Scientist wants to patent research because science advance faster if other researchers can have access to the knowledge. There are still uncertainties, and other countries may not have been exposed to technologies. Developing countries are normally concerned with a natural process and can find the behavior offensive. The research should not be a violation of law. This is what scientist, doctors, and researchers do. The world needs constant advancements to help find cures for diseases, new medicines, and much more. Biomedical research is performed and funded in many countries. For many years science has not only been the individual pursuit of people with unusual ideas, but rather it involves the funding of research by public or private money, consisting of taxes, charities and business investments. We should not be surprised therefore to hear the justifications for the funding of the project in terms of the business opportunities (Macer, 2000). The information should be shared, other countries could benefit from the knowledge. Is the doctor’s research an abuse of technology? Yes, the doctor's research is an abuse of technology. If you are following the protocol of what it takes to screen any new technology that a person has invented. The creation of any new technology should always be tested no matter what. How does a person know if it has a side effect or any defects in it. It is abuse if the doctor decides to still go ahead and use the research without the consent of the government screening it first. This should apply to anything that has anything to do with using technology on human beings. Humans and animals are the main objects when it comes to testing inventions. That's it should be more consideration when it comes to using the invention on people. It's bad enough that the animals have no say so as to what they can and cannot do. But as people it should be treated with such dignity. Anything dealing with human lives should not be taken lightly. There should be no inventions allowed to be exposed without it being approved by the government. If they want to use their research without it being tested then it should be use on them until it is approved by the government or medical facility. Does such research have any victims? This is a very interesting question. There could be a lot of people who could benefit from this type of research. There is such a long list when it comes to patients needing organs so that they can continue living but there are not enough organs for all those that are in need. Now that scientist has come up with a computer program that they are using in order to develop human cells and they could be able to build human organs from this research. The way there could be victims from this type of research are if the organs do not work right or they disintegrate once they are put into a human. When it comes to research and development of this type of science at some point and time they are going to have to implant them into humans. They can do all sorts of testing in the lab and maybe even putting the synthetic organs into animals but until they use them in humans they will never be totally sure if the organs will work. Then they have to wait until time goes by to find out what will happen with these organs and how well they will hold up as the years go by. Should scientist be able to play with human life this way is the question. Someone would have to be able to put their life on the line and in harm’s way for the research to be able to prove that this is the new and correct way to use this information. There has been much scientific research done to improve the length of all of our lives and someone has always had to be the first one to try the different medical procedures. I am sure there is plenty of people who are waiting for a transplant that would probably volunteer to be the first to receive a synthetic organ if it was to mean that their lives could go on longer then it are expected to now. Should those who develop new technology be required to have their innovations screened? People who have developed new technology should have it screened by the government to make sure there are no defects in the technology. There should be some type of screening for the project because you never know what people are making. You can never be too careful to make sure that there is no bomb or any other form of deadly weapon being made. Also, if the new technology deals with medical you will really need to go through all type of screening. Well, at least you should be required to from the government and some medical facility. This is why people are so cautious about what type of medical doctors are prescribing to them. They have so many new medicines that the doctor's are trying to use patients as a medical test. A lot of the medicine that the doctors are prescribing to patients has more side effects to them than ever. You have to make sure that what they are passing on doesn't have any long term effect. Some of these prescriptions have side effects that will kill you. Sometimes the patients have more problems with the side effects than they do with the actually problem that they are having. That's why is it is important to research and screen any new medicines that are coming out. Could you imagine having technology made out here that has not even by screen or tested by any one. There would be no one living most likely. There is nothing wrong with screening new innovations, it is a great idea. What other strategies may be used to allow society time to evaluate new technology before it is implemented? People are unsure about new technology all the time. Unfortunately, in today’s society there is a lot of people want proof before they are willing to accept new things. They want others to be the scientific experiments instead of themselves. It takes a lot of time and effort on the side of scientists to get people to accept different things. A few years back DNA was a new idea and it was in its infant stage and people were not sure that it was legitimate to be used for finding out if children were theirs and to use it to determine guilt or innocence’s of people who may have committed a crime. Now it is used all the time. In the medical field, years ago no one ever thought that you could transplant someone’s organs into another person. Today it is used as often as possible and it helps save lives. Tomorrow hopefully we will be able to use the organs that are designed through computers and synthetic cells to save lives and help people to live productive lives. Conclusion The question of whether or not the doctor should still be allowed to conduct research in regards to the new technology will remain a subject with mixed opinions. If something is truly a breakthrough then there should never be a time to give up. The research would have to continue in order to perfect the idea. Perfect it enough so when the doctor attempts to have it patented again it would pass with flying colors. The other thing to understand is that the doctor is conducting this research on those who are volunteering. These are individuals who are willing to allow the doctor to use them as guinea pigs. The individuals should be informed of all risks that come with this type of research and if after hearing all risks they are still willing to participate than the doctor should be allowed. Any technology that is new comes with risks. While this technology is more for an advance in science, the fact that human life is being used as the subject many will continue to crucify the doctor for continuing to do research. What is interesting is that those same people that are against the doctor continuing the research will be the ones looking for that technology in the future should it be patented. There is no way to please everyone in the world, but if even one good thing from this new technology then why not go for it? The doctor understands how important this invention could be for the future of science and why no matter what the decision is will continue to conduct research.
