Prison Term Policy Recommendation Paper CJA 314 Introduction In the criminal justice field it is more common to find that members of society are supportive of stricter sentencing guidelines for serious crimes as well as for repeat offenders Criminals who are convicted of armed robbery usually do not receive much sympathy from justice officials or society as they are usually very violent crimes which affect the entire community Armed robbery stories are portrayed widely as it is broadcasted in the media but official data suggest that armed robbery has evidently deceased in number since the early 2000 s There is debate over this decline in numbers although it appears that probable changes in criminal profile may be motivating this observed trend Willis 2006 Many armed robbers are not new to the crime and usually have a criminal history of robbery or criminal behavior in their past some have these offenses on their record and some have been lucky enough to not have gotten caught to date These career criminals are a major problem and commit the most serious crimes over and over again While statistics show that the rate is going down we would like to further propose a bill that would help to stop this crime from occurring all together Our proposed plan to reduce this activity is to double the maximum prison term for anyone convicted of the crime armed robbery These changes will be effective by keeping these offenders behind bars for longer periods of time preventing them from committing the same crimes again I will explain further why this decision will be an effective way to help prevent and deter armed robbery Body Armed robbery careers can be seen as an ongoing measurement with specific features varying as more robbery crimes are committed over time In their early stages as amateurs criminals are inclined to be younger and not as experienced as well as have numerous prior records usually minor offenses In addition the majority of them tend to have committed robberies against individuals rather than businesses A huge percentage of unskillful armed robbers are not likely to go on to becoming repeated robbery offenders Criminals that choose to resume committing robbery offenses will turn out to be more proficient as their career continues They will mature become more likely to rob profitable establishments and will have additional previous criminal records As their careers resume they tend to expand their criminal acts to other areas of crime and are also more prone to committing more robberies employ better planning strategies and be driven by life s desire rather than drugs Willis 2009 First time armed robbery convictions can be sentenced up to 15 years in prison if the victim was not injured during the robbery Law Firms 2009 I recommend that these sentences be doubled even for firsttime offenders While this may seem like a harsh penalty statistics show that there is usually a history of criminal behavior and I believe with such a strict punishment it would help to deter those firsttime offenders from choosing to commit this particular type of crime There may be a decrease in armed robbery and an increase in robbery due to people choosing to not bring a weapon because of the extra punishment that would go along with it This alone could decrease the amount of injuries to innocent victims Thirty years in prison if convicted even with no prior history of criminal activity could serve as a major deterrent for those who are contemplating armed robbery Criminals make a conscious rational and at least partially informed choice to commit crime The rational choice perspective holds that criminal acts are the outcome of the conscious choice and that forecasts whether a person will decide to execute a crime when the value is greater than the costs of violating the law Schmalleger 2009 Criminals will weigh the pros and cons of committing a crime and this has a major result in their decision to continue with the crime or not Most crimes are committed for the need of something whether that be drugs money or attention With these being the reasons behind the decision to commit such a crime these decision become less rational and more to fulfill a selfish want or need If we can adjust our criminal justice system to have punishments severe enough to deter criminal acts I believe this would contribute to a reduction in crime People would choose to get jobs or work hard instead of taking the easy way out and robbing people or businesses for money because the risk of getting caught would be too severe it wouldn t be worth it Many criminals do not plan on getting caught but the few that do think about the consequences could decide to go ahead and commit their crime because with sentencing guidelines the way they are currently even if these criminals were to get caught the punishment is not severe enough to deter them from what they may gain I believe that with stricter sentences this would force criminals to weigh the pros and cons and even if they decide to go ahead and commit a robbery they could choose to leave their weapons at home and this would help prevent injuries to the victim during the crime I believe that criminals will weigh the pros and cons of bringing a weapon to the scene as well as hurting a victim or not since these factors carry additional sentences with them According to the routine activities theory criminals will choose wealthier victims that leave their homes unattended to rob While this type of crime will still cause financial loss the risk of victims getting hurt is very minimal I would recommend that all robberies not just those that are armed be sentenced with double the maximum sentence Our goal is to prevent this crime from occurring altogether as much as possible and we believe that including only armed robbery will result in just as many robberies occurring only without the use of a weapon Due to the emotional and financial impact of robberies and especially armed robberies I recommend that we enforce stricter sentencing guidelines for convicted armed robbers I recommend that these sentencing guidelines apply to those who use a weapon to commit their crime whether the victim was injured or not Doubling the maximum sentences on this crime would serve many positive purposes including keeping these dangerous criminals off the street and preventing them from committing this type of crime again as well as serving as a deterrent for those who are contemplating armed robbery to weigh the pros and cons Doubling a sentence is no small matter and would cause many criminals to think twice before proceeding with their crime I recommend that doubling the maximum sentence be applied to unarmed robbers as well to help deter the criminal act of robberies altogether regardless of whether a weapon was used The rational choice theory supports the fact that most people will weigh the pros and cons before making a choice to commit a criminal act I believe the best way to deter them from committing this crime is by making the punishment severe enough that the gain from the crime would not be worth getting caught As well as our support for this bill we believe that we have the general populations favor in passing this bill also Citizens realize that by enforcing stricter sentences this will show that we will not tolerate this criminal act and we are aiming to stop this crime from happening altogether Those that are in support of this bill would like to see our efforts in ensuring their safety and this is a way to show that we will not tolerate this criminal act anymore Conclusion Armed robbers are fairly new to the crime scene and they usually have long histories of criminal history behind them of less serious crimes In order to prevent these crimes from happening we need to enforce stricter sentencing guidelines on convicted armed robbers The public s opinion is in support of this change as well Even
