09/08/2016 Business Law and Ethics ____________________________________________________________________________ __ Opening Discussion: To create an ethical work environment Morals­ Code of Ethics ● Actually use it, for the little things and big things ● Train your employees with seminars  ● Make sure they actually read it (Think terms and  conditions, you never read it) not just when there is an issue ● Blue Cross­has a slinky on their desk that has the  anon hotline Discipline ● Have consequences  ● You need to protect the whistleblowers ● Act swiftly  ● “We appreciate you helping us keep an ethical  environment” ● You have to monitor ● Have PR for consumers if they bring up an issue “What you do speaks so loudly that I cannot hear what you say.”  ____________________________________________________________________________ __ Chapter 3: ADR Alternative Dispute Resolution ● Arbitration ­ parties choose independant 3rd party  (retired judge or lawyer) to act as arbitrator. Submit their grievances.  ● Arbitration is binding! Even if it says non binding,  because the courts do not want to interfere with an arbitrator.  ● Some states will require arbitration before you go to court. ● Mediation  ● 3rd party (less strict, usually a lawyer) ● Two parties explain situation ● Mediator explains what the law is and shows what  the judge is likely to do to the party and offers suggestions 09/08/2016 ● Non binding, so parties decide if they wish to  accept the suggestions from the mediator, ● Very simple and direct Many people prefer and ADR ● See litigation VS adr worksheet If the ADR doesn’t work, then we have the court system ● Most of our law is common law, court’s decisions ● Trial court is the first court ­ initial stage of litigation ­ one judge  maybe a jury ● 90% are at this level. The whole process is time consuming  ­without expedited it could take minimum of a year ● Appellate court review­ looking for reversible error­ something that may have affected the outcome.  ● Did the trial court apply the right law? Violate the constitutional law of the defendant ● Looks at the transcript ­ everything that has been said has been  typed up.  ● No witnesses or new evidence at this level. Simply just looking at  what they have.  ● They don’t like to overturn the lower courts ­ there must be a  CLEAR error of law. ● Why do they give so much deference to the lower court?  ○ Because he was present! He/she can weigh the  credibility of the witness. We rely just as much on non verbal cues as  verbal. They can feel the sarcasm, or how everyone is responding and  reacting. The appellate court can’t see this. What are the choices of the appellate court? ● Modify dollar amount, or reverse it ● Affirm it ­stands as is ● Send it back­ now that you know the law that you need to apply or  whatever error you made, do it again. And hold another trial ● Determine the scope of the statute Courts:  Reasons a court may not file precedence? ● Different with cases ● Different jurisdiction ­ Laws in CO aren’t the same as those in CA ● Sociological reasons  Courts: can’t all hear every matter. They have to have the authority to hear the case ● Geological ● Dollar amount ● Personal Jurisdiction 09/08/2016 ● Subject Matter Jurisdiction  Federal Courts ­  ● Fed District Court ­ everything is here initially ○ First subject matter is if the US  ● Diversity of Citizenship ­ living in different states­ plaintiff is  seeking 750,000 or more ● Federal court of appeals ­ where you go if you don’t like the way a  federal court turn out.  ● Co is in 10 of 13 circuits.  ● Specialty Courts on the Federal Level ○ Tax ○ Military ● Supreme Court (they usually only hear 1%) ○ Significant Major constitutional issues ○ Health care ○ Abortion ○ Gay Marriage. ○ File a petition ­ if the court grants you, they will hear your case.  State System ● State Trial Courts (district court) ○ No lawyers ○ No Lawyer ○ Handle all matters  ■ If you don’t like that, you could go to  the colorado appelic court ■ From here, you may or may not go  to the CO Supreme court ○ You need to have a connection to that state. The  FL state can’t pull me into their court system because I live in CO ○ ____________________________________________________________ Court Cases: Mon ­ tues : 2pm restraining orders 09/08/2016 Sep 19 ­ criminal nakai ­convicitied of sexual assault ­ bleeding to death Confessed but second language not valid Second jury couldn’t decide 27th Oct ­ 9am
