Casey Anthony Criminal Trial and Civil Trials 1 amp 2 o Trialbymedia case 0 Covered by all major news programs I Nancy Grace was a large contributor to media coverage of the case 0 Sensationalism 0 Due to media coverage and the media s analysis of the case most people believed Casey Anthony would be found guilty I Actual verdict shockedoutraged people 0 Unlike OJ Simpson Casey Anthony was not famous before the trial 0 Gained instance fame during the case 0 Unlike OJ Simpson s lawyers Casey Anthony s lawyer wasn t famous before the trail 0 Gained stardom after the trial Crime and charges 0 Caylee Anthony Casey Anthony s daughter of Orlando FL went missing in June of 2011 o Caylee Anthony s body was found on December 11 2011 0 Crime death of Caylee Anthony 0 Several charges were levied against Casey o 2 main charges I 1st degree murder implies intentpremeditation I Aggravated manslaughter accidental killing 0 Lesser charges making false statements to the police Prosecution o Prosecution had very little evidence to build case around 0 Caylee s body wasn t found for several months which meant that decomposition had removed a majority of the forensic evidence on her body 0 Due to the lack of evidence the prosecution built the case around Casey s moral character 0 Focused on her party lifestyle the lies she told the police 0 Lies by Casey to the police 0 Casey said she had a nanny who watched Caylee and that the nanny had kidnapped Caylee I Casey never had a nanny 0 Casey said she worked at Universal Studios I She did not work there 0 Key question does being a liar equate to being a murderer o Prosecution s theory Casey killed Caylee 0 Casey wanted to live a party life and Caylee was a burden that held her back from doing want she wanted so she killed Caylee Key Evidence 0 Strand of hair was found in the trunk of Casey s trunk 0 Hair strand was DNA tested and results reveled that it belonged to Caylee 0 New forensic technique was used and it showed that the hair was in a decomposition phase I This technique had never been used in court before 0 quotair sampling procedure conducted in Casey s car 0 Process of testing the air to check for certain things I This technique had never been used in court before 0 Testing showed the presence of chloroform I Chloroform is used to suffocate people 0 Inspection of the computer at the Anthony residence showed past Google searches for chloroform 0 When Caylee was found she was in a trash bag with a blanket and some duct tape 0 Location of the body and evidence of the trash bag implied that someone had purposefully transferred her body 0 One key issue was the position of the duct tape in Caylee s body I Prosecution said the duct tape was over Caylee s mouth and nose 0 Would imply that someone had tried to keep Caylee quiet or suffocate her I Defense said the duct tape was just hanging on some part of her body not necessary on her body 0 Cause of death was undetermined I Body was too decomposed 0 physical evidence had deteriorated to the point that a conclusive cause of death couldn t be made Defense 0 Defense s theory accidental drowning in the family swimming pool 0 Claimed that George Anthony Casey s dad Caylee s grandpa had disposed of the body I George Anthony was trained in law enforcement so he would know how to handle crime scenes and how to get rid of evidence 0 Defense said that Casey lied to the police because of her dysfunctional family history 0 Claimed that George had abused Casey as a child I Thus Casey was afraid to turn in her father for fear of what he would do to her 0 quotfantasy forensics the two neverusedincourtbefore techniques that the prosecution used when analyzing evidence 0 Techniques hair decomposition air sampling procedure o The fact that they had never been used in courts and thus never upheld as a legitimate testing measures meant that the defense could poke holes in the results of the testing Prosecution s mistake o 2 main mistakes by the prosecution o Overtrying I Use of the two neverusedincourtbefore forensic techniques weakened the case gt showed that the prosecution had little evidence to substantial their case 0 Overcharging I Using two charges murder manslaughter rather than one showed that the prosecution didn t really know how Caylee was killed premeditated murder or accidental drowning 0 Main problem for thru prosecution no determined cause of death 0 Hard to win a case when you do not know nor can prove how the victim died Summary of important aspects of the case o Prosecution s theory vs Defense s theory 0 Prosecution deliberate murder of Caylee by Casey 0 Defense accidental drowning that was covered up by George Anthony I Casey had little involved in what tapped o Prosecution charged Casey with both 1st degree murder and aggravated manslaughter o In Florida 1st degree murder is a capital offense which means that it carries the death penaHy o prosecution used the 1St degree murder charge as a bluff to get a plea bargain I Idea behind bluff Charge Casey with murder and scare her with prospect of the death penalty f Casey wants to live she would agree to a plea deal and confess 0 Lack of evidence for prosecution hard to reach the burden of proof threshold for a guilty conviction o In criminal cases burden of proof is guilty beyond a reasonable doubt 9799 certain of guilt Verdict 0 Casey was found not guilty on the charges of 1St degree murder and aggravated manslaughter 0 Casey was found guilty on the charges of making false statements to the police Caylee s Law 0 Caylee s Law was developed after the case 0 Imposes stricter requirements on parents notifying law enforcement officials of the disappearance or death of a child 0 Makes it a felony of a parent or legal guardian fails to report a missing child in a timely manner 0 When the law was created people wanted to bring Casey back to court 0 However ex post facto law says that someone cannot be charged for a crime they committed before a law that now makes it illegal was in place New Evidence gt brought to attention after the criminal trial 0 New evidence internet searches 0 Upon further review the computer at the Anthony residence contained search history for a second web brower Two important things were found I Search for foolproof suffocation methods I Casey Anthony s myspace account had been used I These two searches make it seem like Casey had used the computer to look up suffocation methods which she then used on Caylee 0 Despite this new evidence Casey Anthony can t be retried due to doublejeopardy protection within the 5th amendment Civil Trial 1 0 When Casey gave police the fake nanny story she said the nanny s name was Zenaida FernandezGonzalez 0 Someone with that name did exist 0 The read Zenaida because she had been named by Casey Anthony as a suspect received threats from people 0 Zenaida s reputation was ruined 0 Civil case Zenaida FernandezGonzalez sued Casey Anthony for defamation o Defamation any nonfactual statement that hurts someone s reputation I Written defamation libel I Spoken defamation slander I Defamation isn t a crime but rather a civil wrong tort 0 Problem how is Casey Anthony to pay restitution she has no job which means she has no S 0 Case is still ongoing Civil Trial 2 0 Plaintiff Missing Children s Firm 0 When Caylee was missing the Missing Children s Firm spent significant resources to try to find Caylee based on the information Casey shared with the police 0 Since Casey s information was made up ie nanny story the Missing Children s Firm was upset that they spent money on following fase leads 0 The Missing Children s firm sued Casey Anthony and won
