CRM notes for the week 2/22 Section 106 of NHPA -take into account the effects of their actions on historic properties in or eligible for inclusion in the national register -give the ACHP reasonable time to comment What does this mean? *in a nutshell, figure out if there are historic properties likely to be affected, figure out how to mitigate any adverse effects, and do all this in consultation with ACHP, SHPO/THPO, and others *CFR 800 or "The Regs" detail this process *key is accommodation and compromise Step 1: is it an "undertaking"? *any "project, activity, or program funded in whole or in part under the direct or indirect jurisdiction of a federal agency..." -anything agency does or has done on its behalf -anything requiring federal $$ If yes, initiate review *coordinate with other reviews *identify pertinent SHPOs and THPOs to consult *plan to involve the public *identify other consulting parties Identify the APE *APE= area of potential effect -area(s) in which undertaking may cause alterations in character or use in historic properties -don't need to know about particular historic properties to determine APE -should include all areas of potential direct or indirect effects 1 -consultation with SHPO/THPO to determine APE Identification of historic properties *determine scope of ID efforts in consultation with SHPO/THPO -review existing information(background research) -seek info from consulting parties and others *ID historic properties if necessary -"reasonable and good faith effort" -surveys not automatically necessary *ID efforts may include: -background and archival research -consultation with others -oral history interviews/ethnographic research -field surveys Assessing information needs *are sites recorded in project area? *have previous studies been done in project area *examine general background data *request views of SHPO/THPO *seek info from -local governments -indian tribes -local historical and archaeolgoical societies -knowledgeable people Identification Methods *importance of surface conditions and exposure 2 *need for shovel testing/ backhoe trenches *use of remote sensing equipment *survey intensity *often state guidelines/protocol in place, BUT it ultimately depends on the nature of the project 3
