FIN 26074001 THE LEGAL ENVIRONMENT OF BUSINESSLECTURE 2 The Court System Important ConceptljJurisdiction the power of the court to take action Two important kinds 0 Statutory power power to hear a case Each trial court can only hear certain cases 0 Personal jurisdiction power over the people If both of those line up court can lawfully proceed to hear the case A statutory agent is a specific individual that is designated to receive and deliver legal documents Any federal matter must be taken to federal court There are 6 different trial courts in the state of Ohio but they all do the same basic thing Witnesses testify jury decides what happened applies the law and makes a decision Listed in no particular order 1 Probate Court a Litigates matters about when someone dies Finds out about unpaid loansdebt matters b Also handles adoptions Able to designate someone to care for child 0 Addresses guardianships If someone is unable to take of themselves they may require a person to do so for them This court will decide that 2 Juvenile Court a Anything regarding to criminal conduct committed by a childminor from speeding to murder b Also determines paternity if there is question to whom the father is of a child 0 Child abuseneglect can place child elsewhere 3 Domestic Relations Court a Divorces custody of child amount of child support from other parent handles debt or loans they had together b Civil protection Restraining orders evicting someone acts of violence against someone 0 May also modify provisions of divorce if something were to change 4 Municipal Court a Allegations of criminal misconduct Misdemeanor crimes always For felonies an initial hearing may be held here Civil cases Where amount in controversy does not exceed 15000 0 Subdivision Within court Small claims court 0 Amount of 3000 5 Common Pleas Court a Trial jurisdiction for common and civil b Felony trials 0 Civil cases to any amount 6 Court of Plains a Handles litigation When defendant is the government Above the trial courts are the court of appeals then the Supreme State Court Supreme Ohio Court Supreme Indian Court etc and then the US Supreme Court
