CRM notes for 3/2 Resolution of Adverse Effects(800.6) *continue consultation to evaluate alternatives to avoid, minimize, or mitigate adverse effects *must notify ACHP *consultation results in: -memorandum of agreement(MOA) -agency, SHPO/THPO, and ACHP MUST sign -other invited parties can sign, but if they choose not to it doesn't matter -failure to agree-> ACHP comments What can be done to resolve? *anything... provided the law has been followed *section 106 does not prevent destruction of historic properties -BUT it means you can't destroy them without considering adverse effects FIRST -bare minimum, must document historic property before destruction *other common resolutions: -adaptive reuse of properties -project redesigns to preserve certain properties, landscapes, vistas -relocating properties or burying archaeological sites -creating a museum or cultural center Other Issues *section 106 process should be coordinated with other laws (NEPA, NAGPRA, etc..) *unanticipated discoveries after the fact? -should anticipate and document plan, during 106 process -otherwise, if project isn't underway, go back and consult -if project is already occurring.... 1 -agency decides what to do -notifies SHPO/THPO, tribes, and ACHP within 48 hours of discovery -allows another 48 hours for groups to respond -decides what to do after considering any responses Emergencies? *plan in advance, consult, get ACHP approval *if feasible, contact appropriate parties and give 7 days to comment *only applies within 30 days of declaration of emergency Programmatic agreements *alternatives to standard 106 process *useful for odd circumstances, complex projects, or when agency deals with lots of similar and repetitive undertakings(forest service and tree cutting for example) *like an MOA, but done in advance -agency, SHPO/THPO, other intersted parties, and ACHP(must be invited) 2
