101515 State v Pendergrass State v Black The court must show precedent A lawyer cannot speak to another lawyer s client without that lawyer being present Overturned and reversed means the same thing Always look at who won and who lost in order to understand what really happened In both the conclusion was overturned State v Mabrey Provocation is important because it can be seen as defense in some cases The defendant is not guilty There was an error as a opposed to a no error so the decision was overturned the appellate court did not agree with the trial court 9 now it has to be decided whether he should be tried again Brie ng 3 case There s also a question a court has to answer in a case which has the word whether State v Rhodes The courts will not interfere The jury returned the verdict that he struck his wife and that the defendant had a right to whip Rhodes in not guilty and therefore he would have been affirmed which means that the court was not going to change the decision the court agreed with what the lower court had said PER CURIAM means no error Appellate court only reads the transcript of a trial to make a decision with no witnesses and possibly lawyers amp cannot take action of sending someone to jail etc These cases come out of people who are related to each other amp the outcome of the cases in general go from beatings that were permitted and why then you go on to a situation where the courts are unwilling to open up to the public to then the court basically saying that they don t care what is used to beat himher but it s the effect produced NOT the weapon used to produce said effect 9 the court said it would permit these actions in certain cases ex Black to a transition ex Rhodes then you go into Mabrey where the court says they will not let these actions escalate and have certain things happen State v Oliver
