PBIO Week Seven October 68 2015 Endangered Species Continued What was the ESA and what did it do 0 The ESA was speci c to the before that were the Coho Salmon and the Sucker Fish Endangered Species Act ESA used to restrict logging in 24 million acres of forests Wayne National Forest 0 Indiana bats are rare and need old trees to rear their young 0 They crawl between bark and a tree in old trees and have and nurse their young 0 ln Southeast Ohio discovery of Indiana bats in Wayne National Forest put a halt to logging One bat species means no logging for eight years 0 This action may have temporarily saved thousands of trees from being cut 0 Bank Swallows nest in banks in order to raise their young o It is illegal to do anything that threatens an animal on the endangered species list Florida Everglades To use the ESA as a means to protect the Everglades through limits on greenhouse gas emissions we need a candidate Endangered Species 0 Florida Panther less than 50 in the wild Population is threatened with extinction as development continues 0 The Florida Panthers need large areas of land without humans in order to breed and hunt Is the Florida Panther protected under the Endangered Species Act Mountain lions are abundant in the west there is a hunting season they are not listed as endangered If the Florida Panther and a cougar are the same it is NOT protected 0 Beefalo 14 Buffalo 34 Cow Fertile o The strawberry is the plant equivalent of the beefalo Are the Florida Panthers separate species or a subspecies of mountain lion 0 They are not a different species because 200 years ago cougars were found across the us including Florida 0 Therefore there is no protection under the ESA to protect the Everglades based on the Florida Panther o In this case state policy has been extended to protect this subspecies 0 There is a plan in Florida to protect the Florida Panther 0 States are allowed to have their own laws but often little money to do very much Are Plants and Animals equally protected by the ESA PBIO Week Seven October 68 2015 Endangered Species Continued 0 No They are protected at different levels 0 What is the legal basis of the ESA How can the government tell you what you can do with your property 0 Imminent Domain establishes a legal precedent that allows government to take your property if it is needed for the 39public good but they must nancially compensate you nancially 0 Origin of Hunting Laws for most of our European and American history there were no restrictions no limits to hunting or trapping wild animals The unregulated overhunting eventually led to a decline in populations of wildlife This led to hunting regulations applied even on private property The legal basis for such regulations was that animals move around thus animals belong to all of us they are public property even when they are on your private property So we have a right to restrict your use of those animals 0 US Hunting laws prohibit the taking of animal and by extension of that concept the ESA prohibits the destruction of habitat breeding places or food source for endangered animals 0 Any human activity that threatens the survival of species becomes illegal Smallest number of white tailed deer was zero in Ohio 0 Plants do not move thus on private property they are considered the property of the landowner not public property as animals would be and so are not legally protected by same argument 0 On public land parks etc plants are protected just like animals by the ESA but not on private property What do we call groups within an animal species 0 Breed ln domesticated plants types within a species are described as cultivars or varieties ln wild populations a unique group within a species is a 39sub species39 o Is there a test of what a subspecies is o No
